Preamble

  1. These general terms of use govern all relationships between the website www.tendances-meubles.fr published by tendances-meubles.fr, whose identity and contact details are specified in the "Legal Notice" section, and the Internet user.

  2. Any Internet user, as defined below, who wishes to use the website www.tendances-meubles.fr is deemed to have read and understood these general terms of use.

  3. Any Internet user is required to familiarize themselves with any changes to these terms each time they visit the site, as Tendances Meubles reserves the right to modify them at any time.

  2. Tendances Meubles endeavors to provide quality access and allow Internet users to use the communication means provided to them in the best possible conditions.

  3. Due to the nature and complexity of the Internet network, especially its technical performance and response times for consulting, querying, or transferring information data, Tendances Meubles makes its best efforts, in accordance with industry standards, to allow access and use of the Site. However, Tendances Meubles cannot ensure absolute accessibility or availability of the Site.

  4. However, Tendances Meubles reserves the right, without notice or compensation, to temporarily or permanently close the Site, particularly for updates, maintenance, modifications, or changes to operational methods and servers, without this list being exhaustive.

  5. Tendances Meubles is not responsible for any damages of any kind that may result from these changes or temporary unavailability or even the definitive closure of all or part of the Site and/or associated services.

  6. Tendances Meubles reserves the right to supplement or modify the Site and/or the services available there at any time based on technological developments.

  7. It is the Internet user's responsibility to be aware of the possibilities for evolution of computer and transmission means at their disposal so that these means can adapt to changes in the Site.

4.2 Account Creation

  1. Access to certain sections of the Site may require the Internet user to create an account. This is particularly the case for purchasing products marketed by Tendances Meubles on the Site.

  2. The Internet user undertakes not to create an account under the identity of a third party. They are solely responsible for the confidentiality of their login credentials (username and password) enabling them to use their account.   6. Advertising and Promotion on the Site

  7. Tendances Meubles reserves the possibility of distributing free or paid advertising or promotional messages on its Site.

  8. Hypertext Links

  9. Tendances Meubles reserves the possibility of setting up hypertext links on its Site that give access to web pages other than those of its Site, on which Tendances Meubles has no control.

  10. Tendances Meubles disclaims all responsibility regarding access conditions to these sites, their operation, their use of personal data of Internet users, and the content of information provided on these sites as a result of activating hypertext links.

  11. An Internet user who has a personal website and wishes, for personal purposes, to place a simple link directly to the Site's homepage, must obtain express authorization from Tendances Meubles to establish this link.

  12. Under no circumstances can this authorization be considered an implicit affiliation agreement.

  13. In any case, hypertext links to the Site without the authorization of Tendances Meubles must be removed upon first request from Tendances Meubles.

9.1 General Responsibility

9.2 Responsibility regarding Information on the Site

  7. Internet User's Obligations

  11. Intellectual Property Rights

  12. In accordance with Articles L. 111-1 and following of the Intellectual Property Code, Tendances Meubles holds the intellectual property rights to the Site, which constitutes a work of the mind.

11.1 Copyright

  1. The overall structure and content of the Site, including texts, slogans, animated or non-animated images, photographs, logos, software, and any other element composing the Site, are the exclusive property of Tendances Meubles or third parties who have granted it a license.

  2. Any reproduction, representation, use, or modification, by any means whatsoever and on any medium whatsoever, of all or part of the Site and all or part of the different works that compose it, without the express authorization of Tendances Meubles, is strictly prohibited and would constitute an infringement liable to engage the civil and criminal liability of the infringer.

  4. 11.2 Trademark Rights

  1. The distinctive signs of Tendances Meubles and its partners, such as domain names, trademarks, names, as well as logos appearing on the Site, are protected by the Intellectual Property Code. Any total or partial reproduction of these distinctive signs made from elements of the Site without Tendances Meubles' express authorization is prohibited, within the meaning of the Intellectual Property Code.

  2. Only use consistent with the purpose of the Site is authorized. Any other use, not expressly authorized in writing and in advance by Tendances Meubles, is prohibited and constitutes counterfeiting.

  3. Tolerance

  4. The Parties mutually agree that the fact that one of the Parties tolerates a situation, regardless of its frequency and duration, does not have the effect of granting the other Party acquired rights or of modifying these general terms of use.

  5. Furthermore, such tolerance cannot be interpreted as a waiver of enforcing the rights in question.

  6. Titles

  7. In the event of difficulties in interpretation resulting from a contradiction between any of the titles at the top of the clauses and any of the clauses, the titles will be deemed nonexistent.

  8. Nullity

  9. If one or more stipulations of these general terms of use are held to be invalid or declared as such in application of a law, a regulation, or following a final decision of a competent court, the other stipulations will retain their full force and scope.

  10. Applicable Law

  11. These general terms of use of the Site are governed by French law.

  12. This applies to substantive and formal rules, regardless of the place of performance of substantial or ancillary obligations.

  13. Jurisdiction

  14. IN THE EVENT OF A DISPUTE REGARDING THE INTERPRETATION OR EXECUTION OF THESE GENERAL TERMS OF USE, THE COMPETENT JURISDICTION WILL BE DETERMINED IN ACCORDANCE WITH COMMON LAW PROVISIONS FOR INTERNET USERS ACTING AS CONSUMERS.

  15. FOR INTERNET USERS ACTING AS BUSINESSES, EXCLUSIVE JURISDICTION IS GRANTED TO THE COMMERCIAL COURT OF RENNES, REGARDLESS OF THE NUMBER OF DEFENDANTS OR WARRANTY APPEALS, IN CASE OF DISPUTE CONCERNING ALL CONTRACTUAL OR NON-CONTRACTUAL RELATIONS.
